Welcome to Testifya. These Terms and Conditions (“Terms”) govern your access to and use of the Testifya website, applications, online test series, mock tests, courses, study materials, educational content, subscriptions, and related services (collectively, the “Services”).
By accessing, registering on, purchasing from, or using Testifya, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.
If you do not agree with any part of these Terms, you must not access or use the Services.
1. Definitions
For the purposes of these Terms:
“Testifya,” “Company,” “we,” “us,” or “our” means Testifya and its owners, operators, affiliates, or authorized representatives.
“User,” “you,” or “your” means any individual or entity accessing or using the Services.
“Content” includes mock tests, test questions, answer keys, solutions, explanations, videos, PDFs, notes, study materials, courses, graphics, text, software, databases, and other educational materials made available through the Services.
“Teacher,” “Instructor,” or “Creator” means any individual or entity that creates, uploads, publishes, sells, or distributes educational content through Testifya.
“Account” means the registered user account created to access certain Testifya Services.
“Purchased Content” means digital educational content, courses, test series, subscriptions, or other Services purchased by a User.
2. Eligibility
You must be legally capable of entering into a binding agreement under applicable law to use Testifya.
If you are under the age required to enter into a legally binding agreement, you may use the Services only with the involvement and consent of your parent or legal guardian.
By using Testifya, you represent that the information you provide is accurate and that you have the legal capacity to accept these Terms.
3. User Accounts
Certain Testifya Services may require you to create an Account.
You agree to:
Provide accurate, complete, and current information;
Maintain the confidentiality of your login credentials;
Not share your Account credentials with another person;
Immediately notify Testifya of any unauthorized use of your Account;
Keep your Account information updated; and
Accept responsibility for activities conducted through your Account.
Testifya reserves the right to suspend or terminate Accounts containing false, misleading, fraudulent, or incomplete information.
An Account is personal to the registered User and may not be transferred, sold, or assigned to another person without written authorization from Testifya.
4. Educational Services
Testifya provides educational resources primarily for learning, examination preparation, practice, revision, and assessment purposes.
Our Services may include:
Online mock tests;
Test series;
Practice questions;
Previous-year-style questions;
Study notes;
Video lessons;
Courses;
Solutions and explanations;
Examination preparation materials; and
Other educational resources.
Testifya does not guarantee:
Admission to any educational institution;
Selection in any examination;
Employment or recruitment;
Qualification or certification;
A particular examination score;
Rank or merit position; or
Any specific academic or professional outcome.
Individual results depend on numerous factors, including preparation, effort, examination difficulty, competition, and circumstances outside Testifya's control.
5. Examination Information and Accuracy
Testifya makes reasonable efforts to provide accurate and useful educational information.
However, examination syllabi, patterns, eligibility criteria, dates, regulations, answer keys, recruitment rules, and other official information may change from time to time.
Users should independently verify important examination-related information from the relevant official examination authority or institution.
Testifya shall not be responsible for losses arising solely from reliance on outdated, incomplete, or subsequently changed examination information.
6. Purchases and Payments
Certain Services may require payment.
By purchasing any Service, you agree that:
The information provided during payment is accurate;
You are authorized to use the selected payment method;
Applicable fees and taxes may be charged;
Payment must be completed before access is provided unless otherwise stated;
Prices may be changed, modified, or discontinued at any time; and
Promotional offers may be subject to separate conditions.
Unless expressly stated otherwise, purchased digital Content is licensed to you for personal use and is not sold to you as intellectual property.
Testifya may use third-party payment processors to process transactions.
7. Digital Content and Access
For digital products, access may be provided electronically after successful payment.
The duration and scope of access may vary depending on the particular product, course, subscription, or test series purchased.
Testifya may specify:
Access duration;
Number of attempts;
Device limitations;
Download permissions;
Streaming restrictions;
Test availability periods; and
Other product-specific conditions.
Access may automatically expire when the applicable access period ends.
8. Refund and Cancellation Policy
Refunds, cancellations, replacements, and related matters shall be governed by the Testifya Refund Policy applicable at the time of purchase.
Because many Testifya products consist of digital educational content that may become accessible immediately after payment, such products may not be eligible for cancellation or refund except where expressly permitted under the applicable Refund Policy or required by applicable law.
Users are encouraged to carefully review the product description, syllabus, duration, access conditions, and other relevant information before making a purchase.
9. Intellectual Property Rights
All intellectual property associated with Testifya and its Services, including but not limited to:
Questions;
Mock tests;
Test series;
Answer keys;
Solutions;
Explanations;
Videos;
Study materials;
Notes;
Course content;
Logos;
Trademarks;
Graphics;
Website design;
Software;
Databases;
Compilation and arrangement of Content; and
Other proprietary materials
may be owned by Testifya, its licensors, Teachers, Creators, or other authorized content providers.
Such Content is protected under applicable intellectual property and copyright laws.
No ownership or intellectual property rights are transferred to a User merely by purchasing or accessing the Services.
10. Limited User License
Subject to these Terms and successful purchase or authorization, Testifya grants you a limited, non-exclusive, non-transferable, revocable license to access and use the applicable Content solely for your personal, non-commercial educational purposes.
You must not, without prior written permission from Testifya:
Copy Content;
Reproduce Content;
Republish Content;
Sell or resell Content;
Redistribute Content;
Share paid Content;
Upload Content to another website or platform;
Record classes or videos for redistribution;
Modify or commercially exploit Content;
Create competing products using Testifya Content;
Share test-series credentials;
Distribute PDFs or study materials;
Circumvent access restrictions; or
Make Content available to third parties.
Any unauthorized distribution may result in suspension or termination of access and may also result in legal action where applicable.
11. Prohibited Activities
Users must not:
Share Account credentials;
Create Accounts using false information;
Circumvent platform security;
Attempt unauthorized access to another Account;
Use bots, crawlers, scraping tools, or automated systems without authorization;
Copy or extract substantial portions of the platform's database;
Reverse engineer the Services;
Introduce malware, viruses, or harmful code;
Interfere with the operation of the platform;
Attempt to bypass payment or access controls;
Upload unlawful, defamatory, abusive, harmful, or infringing material;
Infringe the intellectual property rights of Testifya or others;
Use the Services for fraudulent or unlawful purposes; or
Engage in any activity that may damage the platform or other Users.
Testifya may investigate suspected violations and take appropriate action, including suspension or termination of Accounts.
12. Test Integrity and Fair Use
Users must complete online tests and assessments fairly.
You must not use unauthorized assistance, automated systems, answer-sharing methods, or other techniques intended to manipulate test results or defeat assessment mechanisms.
Where Testifya reasonably suspects cheating, fraud, multiple-account abuse, credential sharing, or manipulation of test results, it may:
Cancel or invalidate test attempts;
Restrict access;
Suspend an Account;
Terminate an Account; or
Take other appropriate action.
13. Teachers and Content Creators
Teachers and Creators are responsible for Content they upload, publish, distribute, or sell through Testifya.
By submitting Content, a Creator represents and warrants that:
They own the Content or have the necessary rights and permissions;
The Content does not knowingly infringe third-party intellectual property rights;
The Content complies with applicable laws;
The Content does not contain unlawful or prohibited material; and
The information provided is accurate to the best of their knowledge.
Testifya may review, modify, restrict, suspend, or remove Content where reasonably necessary or where it believes the Content violates these Terms, applicable law, platform policies, or third-party rights.
14. Creator Payments and Revenue Sharing
Creator earnings, commissions, revenue-sharing arrangements, payment schedules, withdrawal requirements, deductions, taxes, refunds, and related matters may be governed by separate agreements or policies applicable to Teachers and Creators.
Testifya reserves the right, where permitted by applicable law and relevant agreements, to withhold, adjust, offset, or recover payments in connection with:
Refunds;
Chargebacks;
Fraud;
Payment disputes;
Policy violations;
Duplicate transactions;
Unauthorized transactions; or
Legal or regulatory obligations.
15. User Reviews, Feedback, and Submissions
Users may submit reviews, comments, suggestions, questions, feedback, or other materials to Testifya.
By submitting such material, you grant Testifya a non-exclusive, worldwide, royalty-free right, to the extent permitted by law, to use, reproduce, adapt, publish, display, and distribute the submission for legitimate business and platform-related purposes.
You represent that you have the necessary rights to submit such material.
Testifya is not obligated to publish or retain every submission.
16. Third-Party Services
Testifya may use or integrate with third-party services, including:
Payment processors;
Hosting providers;
Analytics services;
Communication services;
Authentication services;
Video or content delivery services; and
Other technology providers.
Third-party services may be governed by their own terms, policies, and privacy practices.
Testifya is not responsible for the independent actions, policies, availability, or content of third-party services except to the extent required by applicable law.
17. Platform Availability
Testifya will make reasonable efforts to maintain the availability and functionality of its Services.
However, uninterrupted or error-free availability cannot be guaranteed.
The Services may occasionally become unavailable because of:
Maintenance;
Software updates;
Server or hosting problems;
Internet connectivity issues;
Cybersecurity incidents;
Technical failures;
Third-party service failures;
Power or infrastructure failures; or
Circumstances beyond Testifya's reasonable control.
Testifya may modify, suspend, restrict, or discontinue any portion of the Services where reasonably necessary.
18. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Services and Content are provided on an “AS IS” and “AS AVAILABLE” basis.
Testifya does not warrant that:
The Services will always be available;
The platform will be completely error-free;
Content will always be complete or current;
Every technical issue will be immediately resolved;
The Services will satisfy every User's requirements; or
Use of the Services will produce a particular academic, examination, employment, or professional result.
Nothing in these Terms excludes any warranty or consumer right that cannot lawfully be excluded under applicable law.
19. Limitation of Liability
To the maximum extent permitted by applicable law, Testifya and its owners, employees, affiliates, partners, Teachers, Creators, licensors, and service providers shall not be liable for indirect, incidental, special, consequential, or punitive losses arising from the use of or inability to use the Services.
This may include, where legally permissible:
Loss of profits;
Loss of business opportunities;
Loss of data;
Loss of anticipated results;
Loss arising from examination performance;
Loss arising from admission or employment outcomes; or
Other consequential losses.
To the maximum extent permitted by applicable law, Testifya's aggregate liability relating to a particular claim shall not exceed the amount actually paid by the User to Testifya for the relevant Service giving rise to the claim.
Nothing in these Terms shall limit liability that cannot legally be limited or excluded under applicable law.
20. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Testifya, its owners, officers, employees, affiliates, Teachers, Creators, licensors, partners, and service providers from claims, losses, liabilities, damages, costs, and reasonable expenses arising from:
Your misuse of the Services;
Your violation of these Terms;
Your violation of applicable law;
Your infringement of third-party rights; or
Content or material submitted by you.
21. Account Suspension and Termination
Testifya may suspend, restrict, or terminate your Account or access to the Services where reasonably necessary, including where:
You violate these Terms;
Fraudulent or suspicious activity is detected;
Account credentials are shared;
Unauthorized distribution of Content occurs;
You attempt to compromise platform security;
Applicable law requires action; or
Your conduct presents a significant risk to Testifya or other Users.
Where appropriate and legally required, Testifya may provide notice or an opportunity to address the violation.
Termination does not affect rights or obligations that accrued before termination.
22. Privacy
Your use of Testifya may also be governed by our Privacy Policy, which explains how personal information and other data may be collected, used, stored, and processed.
By using the Services, you acknowledge that you should review the applicable Privacy Policy.
23. Communications
By creating an Account or using the Services, you may receive service-related communications, including:
Account notifications;
Purchase confirmations;
Test and course updates;
Security alerts;
Important service announcements; and
Other transactional communications.
Where applicable and subject to your preferences and applicable law, you may also receive promotional communications.
24. Force Majeure
Testifya shall not be responsible for delay or failure to perform its obligations where such failure results from circumstances beyond its reasonable control, including natural disasters, government actions, internet or infrastructure failures, cyber incidents, strikes, epidemics, war, civil disturbances, or failures of third-party service providers.
25. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of India.
Subject to any mandatory dispute-resolution or consumer-protection rights available under applicable law, disputes arising out of or relating to these Terms or the Services shall be subject to the jurisdiction of the competent courts located in [Jalpaiguri,West Bengal]
26. Changes to These Terms
Testifya may update or modify these Terms from time to time.
The updated Terms will be published on the website or platform with a revised Effective Date.
Your continued use of the Services after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
If a change materially affects your rights, Testifya may provide additional notice where appropriate.
27. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable where legally possible.
The remaining provisions shall continue to remain in effect.
28. Entire Agreement
These Terms, together with applicable policies referenced herein, constitute the agreement between you and Testifya concerning your use of the Services, unless a separate written agreement applies.
Any additional terms specifically applicable to a particular Service, purchase, Creator relationship, or promotion may also apply.
